Hi, all! This is my first post, so sorry if it's the wrong forum. I have a question regarding joint ownership and a tenant. Here's the scenario:

My two brothers own equal shares in a residential home in Brooklyn. One of my brothers,"Joe" allowed a friend of his to move in temporarily, until she found a job. This was done with the permission of my other brother, "John". However, the "friend" has lived in the home with them for four years and now "John" wants her out. "Joe" is dragging his heels. It seems as if he doesn't want the friend to go. Does "John" have any legal recourse, so fas as having her evicted?

Do they have a lease with her, or is this just a "nice guys let girl move in" sort of arrangement?

If they have a lease, it should have means mentioned in it for termination. If they don't have a lease, the brother who wants her out should check out the landlord-tenant act for New York. If that doesn't provide enough info, contact an attorney.

Barb,
She does not need a lease! As long as 1 of the owners does not object to her presence the other cannot evict her!

Ah, i would still get legal advice, after all, I'm not a lawyer in the state of New York - but I certainly wouldn't give up! If i want somebody out, i'm going to find a legal way to move them out (but that's just me). Of course, it may affect "family harmony" between the guys, so the one who wants her out has to weigh that as part of his desire to have her move.
